July 29, 2023, I legally purchased a firearm on Saturday afternoon from a Maine-licensed gun shop; the firearm had been specifically ordered for me, I waited for it to come in & they called me to let me know it had arrived.
Additional facts: I am veteran, prior police officer & currently legally own other firearms; all were purchased & legally transferred to me in the State of Maine.
Back to this particular purchase; I went in, handled the ordered firearm, completed the proper federal paperwork, supplied appropriate ID & then waited as they ran my FBI background check...was then was told 'all set'. I then purchased the firearm, the appropriate ammo & a silly sticker. This purchase was just like all other purchases I have experienced of a firearm in Maine.
Today, Tuesday August 1, 2023, the owner of the gun shop tells me over the phone that my "firearm left the shop prematurely". I asked what does that even mean? He stated that FBI & ATF wants "more time" to look into me.
I asked why & was told by the owner that they are not given that information (I know this to be accurate). I told him that I can no longer drive & the earliest I may even be able to get a ride is tomorrow on Wednesday 8.2.2023...he said "You have to give me back the firearm".
I then told him that I have a coworker that drives from Waterville into Augusta each day & that I could have that individual pick it up from me today & then drop it off to him first thing in the morning tomorrow on their way to the office. To which I was told..."I could not give the firearm to anyone as it was an 'illegal firearm' & that it had to remain in my possession & be returned only by me.'
I replied; "I did everything the law requires when purchasing this 'brand new' firearm (no prior history on this gun) & that I had not committed any crime...so how could that equate to me now "being in possession of an illegal firearm"?
Reply was "This is a 'live situation' you need to give me back the firearm." I did not & still do not know what 'LIVE SITUATION' implies. I then told him I needed to call around to find a ride (I called my attorney & ATF).
I then received a call back from the gun shop offering to drive to my home to get the firearm back from me & that is exactly what happened. Someone I have never met came to my home & took back a paid for firearm...I no longer have that firearm.
I did request documentation that I transferred it back to them. That documents states that "Firearm will remain at the store & in our care until 8.3.2023 OR until a response from ATF."
Again, this firearm is paid for, I filled out all the required federal paperwork, it is a new firearm (so no prior history on the gun) I purchased it at a legally licensed shop & it was legally transferred into my name on Saturday 7.29.2023....yet today Tuesday, 8.1.202, I no longer have possession nor access to it.
Legal reasons for gun ownership denial:
1. Felony Convictions: I have never been charged nor convicted of felony in my life.
2. Drug Conviction: I have never been charged nor convicted of a drug crime in my life.
3. Mental Illness or Institutionalization: I have no history of mental illness nor have ever been psychiatrically hospitalized in my life.
4. Domestic Violence, Harassment, & Stalking: I have never been charged or convicted of domestic violence; criminally nor civilly in my life.
6. Terrorizing & Denouncing the Country of America: Nope, still not me.
7. Dishonorable Discharge from American Military: Also, not me; I am an Army veteran with an honorable discharge.
8. Fugitive Status: Also, not me; no warrants for my arrest...I am not fleeing the law.
9. Undocumented Alien; I was born in America...land of free, home of the brave.
10. Facing Criminal Charges: Ohhhhhh this sounds like me!?!
Yet here is the law; if you’ve been charged with a crime that carries a penalty of 1-year in prison or more (a Felony), you cannot proceed with a gun purchase.
I have been charged with FOUR 1st time misdemeanors, that carry a fine, license revocation & 4 days in jail 'IF' convicted. My bail conditions do not prohibited firearms (I just cannot be trusted to drink a beer any longer due to my behavior on Easter Sunday).
I have absolutely NO other criminal background & I have yet to even appear before a court to even plead guilty or not guilty to those 4 misdemeanors, let alone to discuss the facts behind my 'Easter Sunday crime spree'.
Yet to date, I have had my license revoked since May 22, 2023, have paid over 20k, have been threatened with a lawsuit & now a firearm that was sold to me at a licensed Maine gun shop, has been revoked (not fiscally refunded) just revoked to "remain in the care of the store until further notice."
Day 115 since I was "drugged, raped, sodomized, robbed & then arrested."
